Additional User Responsibilities
1. Indemnification Obligations
You agree to indemnify, defend, and hold harmless Doi Mae Salong Mist, its officers, directors, employees, partners, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising from your use of our services, your violation of these terms, your violation of any third-party rights, or any fraudulent, negligent, or wrongful conduct on your part.

You are responsible for complying with applicable privacy and data protection laws when using our services. If you engage our paid services, you agree to pay all fees as specified in our service agreements, provide accurate billing information, maintain valid payment methods, pay invoices within agreed timeframes, and be responsible for any taxes applicable to your use of our services. Failure to meet payment obligations may result in service suspension.
Disclaimers and Limitations of Warranties
1. Service Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. 2. No Guarantee of Results
We make no guarantees regarding business outcomes from using our services. Limitation of Liability
1. Exclusion of Consequential Damages
To the maximum extent permitted by applicable law, Doi Mae Salong Mist shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.
2. Maximum Liability Cap
Our total aggregate liability for any and all claims arising from or related to these terms or your use of our services, regardless of the form of action, shall not exceed the greater of: (a) the total amount paid by you to us in the twelve months preceding the claim, or (b) 10,000 Thai Baht. This limitation applies to all causes of action in the aggregate, including breach of contract, breach of warranty, negligence, strict liability, and other torts.
3. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, weather conditions affecting tea production, government actions or regulations, civil unrest, labor disputes, supplier failures, or telecommunications failures. In such events, our performance obligations will be suspended for the duration of the force majeure event.
4. Essential Purpose
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by applicable law. The limitations of liability in these terms shall apply even if any remedy fails of its essential purpose.
Legal Information and Dispute Resolution
1. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without giving effect to any principles of conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these terms.
2. Jurisdiction
You agree that any legal action or proceeding arising from these terms or your use of our services shall be brought exclusively in the courts located in Chiang Mai, Thailand. You consent to the personal jurisdiction of these courts and waive any objection to venue or inconvenient forum. This does not affect your statutory rights as a consumer if you are located in a jurisdiction that prohibits such waivers.
3. Dispute Resolution Procedures
Before initiating any formal legal proceedings, you agree to first contact us to attempt to resolve any dispute informally. We commit to working in good faith to resolve disputes amicably. If informal resolution is unsuccessful within 30 days, either party may pursue formal dispute resolution through mediation, arbitration, or litigation as appropriate under applicable law.
4. Severability Clause
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these terms. The validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.
5. Waiver
No waiver of any provision of these terms shall be deemed or shall constitute a waiver of any other provision, nor shall any waiver constitute a continuing waiver. Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing.
6. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any specific service agreements you enter into with us, constitute the entire agreement between you and Doi Mae Salong Mist regarding your use of our services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.
7. Terms Modification Policy
We reserve the right to modify these Terms and Conditions at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, through email notification or prominent website notice. Your continued use of our services after changes become effective constitutes acceptance of the modified terms.
Assignment and Transfer Rights
You may not assign, transfer, or delegate any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations under these terms to any third party at our discretion, including in connection with a merger, acquisition, reorganization, or sale of assets.
Any attempted assignment or transfer in violation of this provision shall be void and of no effect.
